India and the EU agree five-year MFN treatment in services under new free trade pact, with review mechanism to assess mobility, market access and fairness.
India and the European Union have agreed to grant each other Most-Favoured-Nation status in services for five years under their proposed free trade agreement, marking a significant step in deepening economic ties between the two sides.
The MFN provision, embedded in the Trade in Services chapter of the agreement, ensures that service providers from India and the EU will be treated no less favourably than those from any third country. In effect, neither side can offer more advantageous treatment to another trading partner without extending the same benefits to the other party, subject to specified safeguards.
The move is designed to provide predictability and parity for businesses operating across borders, particularly in sectors such as financial services, information technology, professional services and consulting. By locking in equal treatment, negotiators aim to reassure investors and service providers that they will not be placed at a competitive disadvantage if new bilateral deals are struck elsewhere.
However, the MFN clause is not blanket in scope. It will not apply to taxation agreements, mutual recognition arrangements for standards or professional authorisations, nor to dispute settlement mechanisms. Both sides have also preserved the right to grant special advantages in border regions for services that are produced and consumed locally.
The FTA text, made public on 27 January, outlines a structured review mechanism. A Joint Committee established under the agreement will undertake a formal assessment in the fourth year after the deal enters into force. That review will examine issues including the entry and temporary stay of Indian students in EU member states, their ability to work during and after studies, and the rules governing the short-term movement of professionals and service suppliers.
Based on its findings, the Joint Committee will determine whether to extend the MFN arrangement beyond the initial five-year term. Either party may also trigger an earlier review if developments arise that adversely affect its interests. Should the clause lapse after five years, previously granted benefits would remain intact, but the obligation to extend new third-country concessions would cease.
The broader free trade agreement, concluded after years of negotiations, aims to lower tariffs on goods, expand market access and encourage greater flows of trade and investment between the world’s fifth-largest economy and the EU’s single market. Services are a particularly sensitive and strategically important component of the pact, given India’s strong export base in IT and business process outsourcing and the EU’s strengths in finance, engineering and high-value consultancy.
Officials on both sides view the MFN commitment as a confidence-building measure that balances flexibility with fairness. For India, securing clearer pathways for professionals and students has been a longstanding priority. For the EU, ensuring a stable regulatory environment for its firms operating in India remains central.
If implemented as planned, the five-year MFN window could provide a crucial testing ground for deeper integration in services — an area often more complex than goods trade due to regulatory, immigration and qualification requirements.
